The Platform includes a module for connecting with listed service providers (the Marketplace), governed by the specific provisions of Article 6 below.
The Publisher may change Platform features at any time without this constituting a material change to the subscribed Service.
Article 5 — User obligations
5.1 Proper use
The User undertakes to use the Platform in accordance with these Terms, applicable laws and regulations, public morals and accepted practice.
5.2 Prohibited conduct
In particular, Users must not:
- use the Platform for unlawful or fraudulent purposes or in a manner contrary to public policy;
- attempt to gain unauthorised access to other Users’ systems or data;
- distribute through the Platform any unlawful, defamatory or third-party-rights-infringing content;
- publish false reviews or information likely to mislead other Users;
- automatically extract, reproduce or exploit Platform data without the Publisher’s prior written permission;
- sublet, resell or make their Account available to third parties.
5.3 Uploaded Content
The User is solely responsible for Content uploaded to the Platform. The User warrants that they hold all necessary rights to this Content and that it does not infringe third-party rights. The User indemnifies and holds the Publisher harmless against any related third-party claim.
5.4 Specific obligations of Professionals
Professionals undertake to inform third parties whose personal data is entered on the Platform (tenants, owners and workers) of their rights of access and rectification in accordance with GDPR obligations.
5.5 Specific obligations of Listed Companies
Listed Companies undertake to keep their professional liability and, where applicable, ten-year insurance certificates up to date and provide them to the Publisher on request. They also undertake not to contact Users met through the Marketplace directly in order to circumvent the connection service.
Article 6 — Marketplace and connecting parties
6.1 Intermediary capacity
The Marketplace connects Users with Listed Companies. The Publisher acts solely as a technical intermediary within the meaning of French Law No. 2004-575 of 21 June 2004 (LCEN). It is not a party to agreements between Users and Companies, and acts neither as principal, guarantor nor co-contracting party.
6.2 No liability for third parties
The Publisher exercises no control over Listed Companies and accepts no liability for their qualifications, insurance, or the quality and performance of their services. Use of the Marketplace and engagement of any Company are at the User’s sole risk. The User alone is responsible for checking every provider’s legal and professional documents before assigning an intervention. Any dispute concerning an intervention must be addressed directly to the relevant Company.
6.3 Specific Marketplace Rules
How the Marketplace operates, listing and ranking criteria, review rules, reporting procedures and Listed Company obligations are set out in the INTERVIMO Marketplace Rules, which form an integral part of the contractual framework.
Article 7 — Publisher liability
7.1 Service provided as is
The Platform is provided as is and as available, without warranties of any kind, express or implied, including any warranty of fitness for a particular purpose, freedom from errors or interruptions, or protection against data loss.
7.2 Exclusion of indirect loss
7.3 Exclusion of liability for third-party acts
The Publisher is not liable for:
- the conduct and actions of Companies listed on the Marketplace, including non-performance or improper performance of an intervention;
- the conduct and actions of other Platform Users;
- interruptions or malfunctions attributable to third-party providers (hosting, networks and internet service providers);
- loss of Content resulting from an event outside its control.
7.4 Liability cap
This cap is the User’s sole and exclusive remedy.
7.5 Availability
The Publisher endeavours, without guaranteeing any result, to keep the Platform available. Interruptions may occur for maintenance or reasons outside its control. The Publisher cannot be held liable for loss resulting from Platform unavailability.
7.6 Force majeure
The Publisher is not liable in a force majeure event within the meaning of Article 1218 of the French Civil Code, including communications network failures, industrial disputes, epidemics, administrative decisions or government action.
Article 8 — Intellectual property
8.1 Publisher rights
The Platform, its source code, interfaces, algorithms (including the scoring system), trademarks, logos and databases are owned exclusively by the Publisher or licensed for its benefit. Any unauthorised reproduction or use constitutes infringement punishable under the French Intellectual Property Code.
8.2 Licence to use
The Publisher grants the User a non-exclusive, non-transferable right to access and use the Platform, limited to the term of the Subscription. This right confers no ownership in the Platform.
8.3 User Content
The User retains ownership of their Content and grants the Publisher a royalty-free licence to host and display it solely as required to operate the Platform.
Article 9 — Personal data
User personal data is processed in accordance with the INTERVIMO Privacy Policy, Cookie Policy, Subprocessors and Transfers List, and Security and Business Continuity Appendix.
As part of the Professional Module, the Publisher may process third-party data (tenants, owners, occupants, workers and service providers) on behalf of the Professional, who acts as data controller. In this situation, the Publisher acts as processor within the meaning of Article 28 GDPR. The INTERVIMO GDPR Data Processing Agreement (DPA) forms an integral part of the contractual framework for the relevant business Clients.
Article 10 — Prices and billing
10.1 Prices
Current prices are available on the Platform’s dedicated page, in the accepted plan or applicable quote. Ordering, payment, billing, renewal, termination, any withdrawal right and refund conditions are set out in the INTERVIMO General Terms of Sale and Subscription.
For business Clients, prices are stated in euros excluding tax, with applicable VAT added to invoices. For consumers, prices must be shown inclusive of all taxes before the order is confirmed.
10.2 Billing
The Subscription is billed monthly by direct debit or any other method accepted by the Publisher. Billing begins on the Account activation date.
10.3 Changes to prices and subscription plans
The Publisher may change existing Subscription prices and introduce new subscription plans or paid services at any time, without being required to offer these new plans to Users with a current Subscription.
Any price change affecting a current Subscription will be notified to the relevant User thirty (30) days before it takes effect. Failure to object during this period constitutes acceptance of the new prices.
Introducing new subscription plans or service levels does not affect the price terms of an existing User Subscription unless the User voluntarily chooses to switch.
If the User rejects a price change affecting their Subscription, they may terminate without penalty under Article 11.
10.4 Payment default
If payment is late, the Publisher may suspend Platform access after a formal notice remains unanswered for eight (8) days. Late-payment penalties at the statutory rate plus five points apply automatically.
10.5 No refunds
Unless the law provides otherwise or the Publisher expressly agrees, amounts paid are non-refundable if the User terminates early.
Article 11 — Term, termination and effects
11.1 Term
These Terms apply for an indefinite period from Account creation. The Subscription is taken out monthly and renews automatically.
11.2 Termination by the User
The User may terminate their Subscription at any time without penalty through the Platform or by emailing contact@intervimo.fr, subject to thirty (30) days’ notice before the next billing date. Termination takes effect at the end of the current period.
11.3 Termination by the Publisher
The Publisher may terminate the Subscription automatically, without compensation or refund, in the event of a serious or repeated breach of these Terms, non-payment after formal notice or fraudulent behaviour. In other cases, the Publisher may discontinue the Platform with sixty (60) days’ notice.
11.4 Effects of termination
From the termination date, Platform access is disabled. The User is solely responsible for exporting and backing up their data before termination. The Publisher cannot be held liable for data loss following termination. The User has thirty (30) days to export data through the Platform. After that period, data may be deleted, subject to statutory retention obligations.
Article 12 — Changes to the Service and Terms
The Publisher may change Platform features or these Terms at any time. Any material change to the Terms will be notified to the User thirty (30) days in advance. Failure to object during this period constitutes acceptance. If the User refuses, they may terminate their Subscription under Article 11.
Article 13 — Governing law and dispute resolution
13.1 Governing law
These Terms are governed exclusively by French law.
13.2 Amicable resolution
In the event of a dispute, the parties undertake to seek an amicable solution first. Any complaint must be sent to the Publisher at contact@intervimo.fr.
13.3 Mediation (consumers)
Under Articles L.612-1 et seq. of the French Consumer Code, any User who is a consumer may use a consumer mediator free of charge after a prior written complaint remains unsuccessful. The appointed mediator’s details must be included in the INTERVIMO Legal Notice before any B2C commercial launch.
13.4 Jurisdiction
If no amicable resolution is reached within sixty (60) days:
- For B2B disputes (between Professionals): exclusive jurisdiction of the court with territorial jurisdiction over commercial matters.
- For B2C disputes (with consumers): the territorial jurisdiction rules of the French Code of Civil Procedure apply, and the User may bring proceedings before the court of their place of residence.
Article 14 — Miscellaneous provisions
Severability. If any provision of these Terms is declared void or unenforceable, the remaining provisions remain in force.
No waiver. The Publisher’s failure to rely on a provision does not waive its right to rely on it later.
Entire agreement. These Terms, the General Terms of Sale and Subscription, Privacy Policy, Cookie Policy, GDPR Data Processing Agreement, Marketplace Rules, SLA and Support, applicable price terms and any accepted special terms constitute the entire agreement between the parties.
